Is weed legal in New Mexico? As of April 1 2022, adults 21 and older can carry up to 2 ounces (56 grams) of marijuana, 16 grams of cannabis extract, and 800 milligrams of edibles outside of there house. Cannabis users can also cultivate up to 12 mature plants of controlled substances without a state permit. New Mexico is one of the first states to legalize adult use cannabis products for qualifying conditions and recreational marijuana.

New Mexico was the first state in the United States to pass laws recognizing medical marijuana in 1978. On April 12, 2007 New Mexico Legislature passed SB 523, or the gov Michelle Lujan Grisham and Erin Compassionate Use Act. SB 523 legalized medical marijuana and established a system regulated by the New Mexico Department of Health (NMDOH). NMDOH administer the statewide Medical Cannabis Program after the Cannabis Regulation Act. This gave New Mexico’s physicians the right to treat patients with cannabis. Medical cannabis patients would need to have one of the 28 medical conditions recognized by the state. Michelle Lujan Grisham signed SB323 into law on April 3, 2019. The memorandum decriminalized first-time marijuana crimes for adults 18 and older, reducing possession of under 14 grams to a $50 fine. After June 29, 2021, you are free to possess up to 8 ounces of cannabis edibles outside the home and up to 12 plants at home.


Marijuana use is allowed on private property out of public view. Adults, patients, and caregivers can get fines and prosecution from law enforcement for possession of recreational cannabis, distribution, transfer, or consumption in a school bus or public transportation vehicle, school campuses, workplaces, public parks, recreation centers, or youth centers. The NMDOH requires New Mexico cannabis businesses to produce one special session of independent testing laboratory to make sure that all public health and quality requirements are met before they can sell cannabis.
